Door Police Interaction , Chad's rights library
Learned 2026-10-26 from Chad's Drive folder "Incoming / new skills / DOOR POLICE INTERACTION". Two documents:
- "Understanding Arrest and False Imprisonment" (Google Doc) , a plain-language primer:
- An arrest = custody where a reasonable person would not feel free to leave: physical restraint or submission to authority, clear communication of arrest, actual or constructive custody, intent to bring the person into the criminal justice system.
- False imprisonment = intentional confinement without legal authority, against the person's will, with the person aware of it. Even a brief unlawful detention counts (Manuel v. City of Joliet, 2017).
-
Three encounter levels: consensual (no justification needed; you may refuse and walk away), Terry investigative stops (reasonable suspicion: specific articulable facts; brief; pat-down only on reasonable fear of weapons, Terry v. Ohio), arrests (probable cause; full search; Miranda before questioning).
-
"Transportation Stop Action Script" by Eddie Craig (former deputy sheriff; FraudStoppers / Rule of Law Radio) , a memorized script for traffic stops:
- Record everything, always; note names and badge numbers; keep a witness on an open phone line.
- Control the exchange and your composure. Say only rights-protecting things. Never answer questions (where from, where going, "do you know why I stopped you").
- Scripted sequence: name and badge; is this being recorded, audio and video, equipment working; what is the emergency; what probable cause; do you have a search warrant, an arrest warrant, may I see it; I am not operating for hire; am I under custodial arrest; if not, am I free to go; invoke silence and counsel; I do not consent to any search or to further detention; repeat the non-waiver line as needed.
- Never consent to a search, even under threat of a canine unit. Windows up, doors locked; one window, open at most 2.5 inches.
- Texas-specific references (Transp. Code 543, Penal Code 38.02 failure-to-identify limits) , treat as Texas law, not Tennessee or federal. Tennessee stops differ; flag the jurisdiction before relying on any line.
Desk use
Background knowledge for the Rafael matter's framing (warrantless seizure, false imprisonment language) and for Chad's own encounters. It is educational material, NOT legal advice and not a substitute for counsel. Quote its lines only as the script's lines, attributed to Eddie Craig. Never present it to an attorney or a court as the desk's legal position without Chad's explicit word.
